私隱政策聲明

以下是一田有限公司 (以下統稱「我們」或「本公司」)根據《個人資料(私隱)條例》(第486章)之規定所訂之私隱政策聲明。我們將確保我們之職員依將執行有關政策，嚴格保密你的個人資料。

本公司保障客戶及本網站用戶所提供之一切資料。除用戶使用會員登記、貨品查詢、“轉寄給朋友”服務時，我們可能需要收集個人資料及記錄用戶電腦的網路位址外，我們不會於用戶瀏覽我們之網站時收集任何足以識辨個人身份之資料。當用戶瀏覽我們之網站時，我們僅將其瀏覽記錄為一次按動次數，並不收集任何個人資料。而此等資料將用於編備有關我們網站使用情況之一般統計資料。

個人資料收集聲明

本聲明乃遵照《個人資料(私隱)條例》(第486章)的要求而發出，通知閣下收集資料的目的、閣下同意我們如何使用這些資料和及閣下的權利。本聲明會不時更改，故請定期查閱。閣下登記使用我們之服務及每次登入我們網站，即表示同意接受當時生效之個人資料收集聲明。

資料之收集

在登記成為用戶及使用我們網站之時，用戶會被要求向我們提供個人識別資料，包括姓名、電郵地址、送貨/帳單地址、電話號碼、手提電話號碼、公司名稱等。我們有必要收集用戶之資料，以便向用戶提供本網站之各項服務及活動。倘若用戶未能提供所需資料，我們將不能向用戶提供我們網站上可供享用之服務及活動。

Privacy Policy Statement

General

YATA Limited ('YATA', 'we', 'our' or 'us') recognize our responsibilities to protect the privacy, confidentiality, and security of the personal information we hold by complying with the requirements of Hong Kong’s Personal Data (Privacy) Ordinance ('PDPO'). We are equally committed to ensure compliance by all our employees and agents with these obligations.

This Privacy Policy explains our collection, holding, and use of recorded information about our customers and various other individuals ('you' or 'your'). It also sets out your rights concerning your information and who you can contact for more information or queries. We may refer to information that can be used to identify you as your ‘personal information’ or 'personal data’. We may also sometimes collectively refer to handling, collecting, protecting, and storing your personal information as ‘processing’ of such personal information.

If you access or use our website (https://sale.yata.hk) (referred to as our ‘Website’ in this Privacy Policy) by any device means, our mobile application YATA-Fans ('App'), or register as a member of our loyalty programme YATA-Fans ('Membership'), then this Privacy Policy applies and is deemed to be agreed by you.

This Privacy Policy does not extend to third-party websites that may be linked from our Website or App. Navigation away from our Website or App means this Privacy Policy no longer governs your interactions with us, including personal information that may be collected, and YATA is not liable for any harm or loss incurred.

The governing version of this Privacy Policy is the English version and shall prevail when there are inconsistencies between the English version and the Chinese version.

Statement of Practices

Collection of Personal Information

We safeguard personal information voluntarily provided by you, collected by us YATA, or any affiliates of YATA or our Partners, or captured automatically. We typically collect or obtain information because you volunteer it to us, or because other users provide the information to us, or because we observe or infer that information about you from the way you interact with us or others.

All types of personal information will not be collected all the time because personal information collection depends on the nature of your interaction with us. Personal information will be used to provide products, services, or marketing promotions to you. Please note that if you refuse or are unable to provide your personal information as required, we may not be able to provide you with products, services or process your application if it requires your personal information.

When we collect personal information from you, we will provide you with a Personal Information Collection Statement (‘PIC statement’, ‘PICS’) on or before the collection in an appropriate format and manner.

Cookies and Silently Collected Data

Cookies are small text files that are stored on your browser or device by websites, applications, online media, and advertisements when you visit a website. Our Website uses cookies to distinguish you from other users, which is not used to collect personal information. This helps us provide you with a good experience when browsing and allows us to improve our Website for enhancing user experience. You may choose to accept or reject cookies in your web browser settings. If you reject the cookies, you will not be able to use some of the functions on our Website.

When using our App as an unregistered user or when you are not logged into your Membership account, our App collects some non-personal data used to provide you with a good experience when browsing and also allows us to improve our App in order to enhance user experience. You may choose to deny such permission requests for our App. However, if you deny such permission requests, you will not be able to use some of the functions on our App.

Minors under the age of 18

Our Website, App and Membership are only intended for people over the age of 18. If you are under the age of 18, you may use our Website, App or register for a Membership if your legal guardian authorises and provides consent for you to use our Website, App or become member of YATA Fans prior to use or registration, before providing any personal information to us on the basis of this Privacy Policy and related PIC statement.

Retention of Personal Information

We maintain your personal information in compliance with legal, regulatory or internal policy requirements, to ensure personal information is not kept longer than is necessary for the fulfilment of the purpose for which the data is collected or is used for. The information will either be irreversibly anonymised or securely disposed of when it is no longer needed. Refer to the relevant PIC statement for further details over retention of personal information collected for specific purposes.

Disclosure of Personal Information

The personal information collected for processing may be disclosed to parties who will be contacted by us during the handling of our Website, App or Membership [applications, websites, systems, etc.]. The information provided may also be disclosed to agencies or organisations that are authorised to receive information relating to law enforcement, prosecution, or review of decisions. Personal information will only be used, disclosed, or transferred for the purposes or any directly related purposes for which it was collected or where it is allowed under the PDPO. Refer to the relevant PIC statement for further details over disclosure of personal information collected for specific purposes.

Direct Marketing

Only with your consent, we intend to use your personal information (e.g. your name, contact phone number, and email address) in direct marketing. We would like to contact you about our products and services and events organised by us on the foregoing services. We would also like to use your personal information for other direct marketing use that we notify you (in the relevant form of collection channels) from time to time. We will not disclose your personal information to any third parties for direct marketing purposes without your consent. If you do not agree to such use of your personal information in direct marketing, please indicate your objection in the acknowledgment form that will be provided to you on collection of such personal information. If you do not wish to continue receiving any direct marketing materials from us, you may e-mail marketing@yata.hk stating your wishes in the relevant direct marketing communication.

Security

We use a range of physical, electronic, and managerial measures to ensure that we keep your personal information secure, accurate, and up to date. These measures include:

education and training to relevant staff to ensure they are aware of our privacy obligations when handling personal information;
administrative and technical controls to restrict access to personal information on a need-to-know basis;
technological security measures, including firewalls, encryption, and anti-virus software; and
physical security measures, such as staff security passes to access our premises.

Whilst there are always risks associated with the transmission of data over the internet (including by e-mail), we take proactive steps to manage these risks and work with business partners who share our view on the importance of protecting your data. We endeavour to protect personal information, but we cannot guarantee the security of data transmitted to us or by us.

Your Rights and Correction

You have various rights concerning your personal information. In particular, you have a right to:

object to YATA processing your personal information;
request access to your personal information from time to time;
request an update of the personal information we hold about you, or correct such personal information that you think is incorrect or incomplete; and
withdraw consent to our processing of your personal information (to the extent such processing is based on consent).

You may also use the above contact details if you wish to make a complaint to us relating to your privacy. We strive to respond to your questions or complaints within 40 days of receiving the communication. In accordance with the terms of the PDPO, we have the right to charge a reasonable fee for processing a data access request. We will clearly inform you what fee, if any, will be charged as soon as possible and in any event not later than 40 days after receiving your request. If you are dissatisfied with the way we handle your personal information and you wish to report a complaint about it, you also have the right to refer the matter to the Privacy Commissioner for Personal Data (PCPD) in Hong Kong.
